Dispute Resolution and Litigation

We understand the dispute resolution procedures included in all standard forms of contract, and can assist in contractual dispute resolution from the issuing of notices through to negotiation, arbitration or litigation. Our understanding of construction combined with our experience in contractual disputes allows us to help our clients identify the essence of the dispute and the best way to reach a solution. Two of our team members are qualified arbitrators, and have acted as arbitrators in a number of large disputes.

We have acted, or are currently acting, for our clients in the following disputes:

  • A Supreme Court case regarding a failed joint venture in which our client was wholly successful.
  • An ongoing Supreme Court case between a builder and developer relating to enforcement of an award under the Building and Construction Industry Security of Payment Act. The case involves complex security of payment and corporations law issues.
  • An ongoing Supreme Court case between a builder and developer regarding issues of completion and defective works.
  • An ongoing Supreme Court case between a builder and an owners corporation regarding the operation of limits of accuracy in a construction contract. The case also involves complex equity, corporations and insolvency issues.
  • A Consumer, Trader and Tenancy Tribunal case between a builder and a home owner in relation to variation works.
  • A $3m arbitration between a civil contractor and one of its subcontractors.
